All alimony is not created equal

When Florida couples divorce, it is often after months or years of trying to repair the relationship. In many cases, one spouse pays money to the other after the settlement. If you are considering divorce, it is worth noting that the court can use its discretion when determining how much and length of the payments. At The Minaya Law Offices, PLLC, we often represent clients who wish for some form of spousal support after the divorce.

 According to LiveAbout, judges have a great deal of latitude when awarding alimony, also known as Spousal Maintenance. The court considers several factors when deciding alimony, such as the following

  • Length of the marriage
  • Age of the spouses
  • Emotional, mental and physical status of each spouse
  • The contribution of each to the marriage
  • When the custody of a child affects one spouse’s earning potential

Depending on the circumstances, a judge may award temporary, permanent or rehabilitative alimony. Temporary alimony lasts for a specific period. The intent is to help you financially recover from hardship caused by the divorce.

If you or your soon-to-be-ex was a homemaker for the duration of the marriage, assistance paying for schooling or job training might be necessary. In these circumstances, the judge may award rehabilitative spousal support.

Permanent alimony may be appropriate if one spouse has a disability that limits their earning potential. Another situation in which the court may award permanent alimony is if the marriage was long-term and one spouse did not work the entire time. In these circumstances, spousal support may continue even if the recipient remarries.
